Terms & Conditions

Please read the following Terms & Conditions BEFORE you book your cabin on the cruise. This document contains important limitations on your rights. This is a legally binding terms and conditions document. This document contains additional contractual terms, conditions and limitations between you and LIVE SCAPE SDN BHD (201001039414), (“LIVESCAPE” or their respective officers, directors, employees, agents, sponsors and contractors collectively referred to herein as the “Released Parties”), with respect to this cruise beyond the terms and conditions described in the HWAJING TRAVEL & TOURS SDN. BHD (198901009101).Booking Terms and Conditions and more information can be found in the link – www.itstheshipfam.com 

All references to “Guest” shall have the same meaning as “Passenger” for purposes of this Contract and shall include each shipmate listed on a Ticket Contract and each guest, other than LIVESCAPE personnel, Costa Serena, Hwajing travel & Tours personnel and artists and talents personnel, who embarks on the Cruise or attends any Cruise or Cruise related events, whether or not listed on a Cruise Ticket Contract. All terms shall be considered gender neutral and pronouns shall refer to the masculine and feminine, as context requires.

CRUISE TICKETS

  • All prices are fixed and non-negotiable. Prices are as advertised at the time of purchase, and may change without prior notice.
  • The company reserves the right to increase the fuel surcharge at any time, subject to foreign currency fluctuations.
  • Discounts, promotions, and special offers are subject to availability and may be withdrawn at any time without notice.
  • Tickets are issued for personal use only and are non-transferable.
  • Tickets may not be resold or offered for resale at any price. Any tickets that have been resold or transferred unofficially will be considered void and will not grant to get onboard.
  • The cabin’s passenger must be present at the event and required to provide valid identification matching the name on the ticket.

GOVERNMENT TAXES, FEES AND GRATUITIES

  • Mandatory Government taxes, port and ticketing fees totalling USD160 per passenger will be charged with your cruise fare.
  • Gratuities will be charged to your cabin account at the time of boarding in the amount of USD48 per shipmate for Standard cabins (Interior, Oceanview and Balcony) and USD57 per shipmate for Suites (Mini Suite, Suite and Grand Suite)
  • Costa Cruises charges per passenger gratuity as part of standard cruise offering. The gratuity will be charged onboard to our passengers’ cabin card and payment is made at the end of the cruise when the shipmate settles their onboard expenses.
  • Casino dealers and spa personnel are not included since not all shipmates will utilize those services. Gratuities for bar services and servers will be included on all bar checks, added to the price of your drinks.

AGE REQUIREMENTS / WHO MAY SAIL

  • Passengers are not allowed to travel if they will be in their 24th week of pregnancy or beyond at any time during the cruise. 
  • At boarding, all pregnant women must present a medical certificate from a gynecologist confirming that both mother and baby are in good health and fit to travel. The certificate must also state the estimated delivery date. 
  • Costa Cruise and Livescape are not responsible or liable for any pregnancy-related complications that occur during or after the cruise.
  • Children under 18 years of age may not travel unaccompanied on board the ship. 
  • Babies younger than 6 months old on the first day of the cruise are not permitted to board.

CABIN NUMBER ASSIGNMENTS

  • Passengers will be assigned a cabin automatically based on the best availability at the time of booking.

PASSPORT & LEGAL DOCUMENT REQUIREMENTS

  • The Passenger shall have their own identity documents (e.g. identity card, passport, residence permit) valid for travel abroad, depending on your nationality, for all countries on your itinerary. 
  • For international travel, passengers of all ages must have a valid passport. Therefore, if your child is traveling with you, please ensure they have a passport ready before departure. 
  • A passport expiry date of at least 6 months from the date of sailing is required.
  • It is also the responsibility of the Passenger to obtain residence and transit visas and any health and/or vaccination certificates that may be required. It is the responsibility of the Passenger to obtain the necessary travel documents for embarkation. 
  • Costa Cruise may deny access to the ship to any Passenger who does not have the required travel documents, without recognizing any reimbursement of the price paid or compensation for loss of enjoyment of the cruise.

REFUSAL OF PASSAGE

  • Transportation on the Cruise may be denied to any shipmate who, in Organiser’s or Costa Cruises’s sole discretion:

(1) is or becomes in such a condition as to be unfit to travel

(2) is dangerous or obnoxious to others or

(3) is inadmissible under the laws of any country of debarkation

  • In addition, Organiser and Costa Cruises reserve the right to refuse passage, disembark or confine to a cabin any passenger whose physical or mental condition or behavior they consider, in their sole discretion, to constitute a risk to the passenger’s own well-being or that of any other passengers.
  • Organizer and Costa Cruises has the right to disallow booking or boarding to any passenger that, in the opinion of Organiser and Costa Cruises, may impact the cruise, other passengers, or artists in a negative or disruptive way. Organizers and Costa Cruises shall have unilateral rights in any such decisions.
  • The Released Parties shall have no liability to any such passenger or any third party arising out of any such decision. Any costs resulting from Organiser ’s and/or Costa Cruises’s decision, including, without limitation, costs of lodging and transportation, shall be the responsibility solely of the passenger.
  • Passengers’ behavior shall not affect the safety, comfort, wellbeing or enjoyment of other Passengers. Passengers shall act prudently, follow all instructions issued by the Organizer and comply with any administrative or statutory regulations that apply to the voyage as well as with any legal requirements in the countries included in the cruise.

PHOTOGRAPHY & VIDEO

  • Organizers and/or its promotional partners have the exclusive right to include photographic, video and other visual portrayals of passengers in any medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to passengers, and all rights, title and interest therein (including all worldwide copyrights therein) shall be Organizers sole property, free from any claims by organizers or any passenger deriving any rights or interest from passenger.
  • A video crew may be shooting footage to be used for the promotion of future events. When the video team is shooting any particular location/venue on the ship, your presence at the said location/venue acknowledges your permission for your likeness to be used in future, non-broadcast/broadcast promotional videos, TV shows or still pictures. If you do not wish to be filmed please notify the video crew and be prepared for them to ask you to exit the location/venue for a short time until taping is complete.

VENDING

  • You may not sell, promote, distribute or offer for sale any merchandise, goods, souvenirs or other products on the Cruise without first obtaining Organizer’s and Costa Cruise’s written approval.

LIQUOR & BEVERAGE POLICY

  • Passengers are prohibited from bringing any alcoholic, non-alcoholic beverages or any raw or cooked food on board. 
  • We reserve the right to refuse the sale of alcoholic beverages to anyone.
  • Costa Cruise Lines reserves the right to retain alcoholic beverages purchased at ports of call until the end of the cruise.

RIGHT TO CHANGE ITINERARY

  • Organizers and/or Costa Cruises reserve the right, at any time, to change the cruise itinerary, program, line-up, and event locations whenever advisable or necessary. In this case, Organizers and/or Costa Cruises will NOT be responsible for any loss or expenses caused by reason of such changes or abandonment. 
  • Refunds will NOT be made to shipmates who select not to complete the cruise for any reason or cause whatsoever. 

CANCELLATION BY ORGANIZER AND/OR Costa Cruises

  • In the event of strikes, lockouts, riots, labor stoppages, or any other circumstances beyond the control of the Organizers or Costa Cruises.
  • Costa Cruise reserves the right to cancel or substitute any scheduled port call, itinerary, price, program, vessel, or cabin at any time without prior notice. Neither Costa Cruises nor the Organizers shall be liable for any loss to passengers due to such changes.
  • If the Cruise is completely cancelled, the Organizers will refund your cabin fare, along with related taxes and fees. If the Cruise is partially cancelled, a proportionate refund will be provided. Under these circumstances, the Organizers and Released Parties will have no further liability for damages or compensation.
  • Please note that the cancellation policies for travel insurance and other travel products (airfare, hotel, car rental) do not apply in this context.
